BOOM KITES/NOVA International

1) Acceptance
The acceptance of the buyer's order is limited to the terms and conditions stated herein. Any additions, deletions or differences in the terms will not be binding upon BOOM KITES/NOVA International unless specifically agreed to in writing. BOOM KITES/NOVA International accepts purchase orders by mail, e-mail, fax and through the web shop.

2) Validation of contract
The contract between the buyer and BOOM KITES/NOVA International is accomplished when BOOM KITES/NOVA International confirms acceptance of the order by sending the goods and sending a confirmation message to the buyer.

3) Retention of title to the invoiced goods will only pass to the buyer, when full payment of the invoice is received. This will apply to all transactions between the parties unless varied in writing by both parties.

4) Prices
Prices of the goods are published in the shop of this web site and are current at the time of publication; we reserve to change them without notice. Please note that prices will vary depending on where you want the goods to be shipped to and also note that you might need to pay local taxes for imports.

5) Shipment
BOOM KITES/NOVA International will ship the goods from Innsbruck usually within 5 days of the date of receiving the order - we usually ship the day we receive the money on our account. In the event the manufacture, procurement or delivery is impossible or cannot be expected of BOOM KITES/NOVA International in time due to events of force majeure or any other unforeseeable, extraordinary circumstances through no fault of our own such as lack of raw materials, operational disruptions or industrial actions at our factory, our suppliers or at transport companies, the delivery period shall be extended in a reasonable scope. BOOM KITES/NOVA International will however try to keep delivery time as short as possible and inform the buyer of delays. If delivery is not possibly BOOM KITES/NOVA International will inform the buyer as soon as possible and pre-payment will be refunded.

6) Returns
All returns must be made within 2 weeks of the original date of shipment, the products must be originally packed and unused. Returns are accepted only to the address given below. The Purchaser may cancel his order only upon written notice and upon payment to BOOM KITES/NOVA International of the reasonable and proper cancellation charges. Returned goods must be sent by normal parcel post unless any other written agreement was made and accepted. Used products can not be returned unless a written agreement was made and accepted or in case of warranty. Consequences of returns: In case of accepted returns both parties have to return the benefits from the transaction.

7) Privacy Statement BOOM KITES/NOVA International collect information about you for two reasons: firstly, to process your order and second, to provide you with the best possible service. BOOM KITES/NOVA International will NOT pass your details on to a third party. (We also hate SPAM)

8) Court of jurisdiction The place of jurisdiction for all disputes resulting from this agreement shall be Innsbruck. We shall also be entitled to file an action before the court at the registered office of the Buyer.

9) Warranty BOOM KITES/NOVA International warrants that the products that it manufactures and sells are delivered free from defects in material and workmanship. BOOM KITES/NOVA International's liability under this warranty is limited to replacing or repairing, at its option, any product which is returned to BOOM KITES/NOVA International, transportation charges prepaid, and which is determined by BOOM KITES/NOVA International to be defective. This warranty does not apply to any product which has been damaged due to misuse, misapplication, or which has been repaired or altered without express prior and written consent from BOOM KITES/NOVA International or which has been subjected to misuse, negligence, or accident. The Buyer must check the goods immediately after receiving them to be complete and free from defects. If there should be any defects they must be reported to BOOM KITES/NOVA International immediately, at least within 8 days in written form.
